Extension of reliefs granted to the pensioners from time to time to the remaining categories of pensioners.

No.F.1 (47) FD (Gr.2) / 88-II                 

Jaipur, dated the 2.12.1989

Sub:     Extension of reliefs granted to the pensioners from time to time to the remaining categories of pensioners.

            The State Government has been granting relief to the existing pensioners from time to time. The amount of minimum pension/family pension in respect of pre- 1.9.1986 pensioners was raised to Rs. 300/- per month vide this Department order No.F.1(29) FD (Gr.2) 87-II dated 20.10.1987. The formula for computation of pension in respect of employees retiring on or after 1.9.1986 was revised and this revised formula was extended to the pre-1.9.1986 pensioners vide this department order No.F.1 (29) FD (Gr.2)87-III dated 20.10.1987. The provisions of the New Family Pension Rules vide this Department order No. F.1 (50) FD (Gr.2) 82 dated 18.7.1988. In respect of employees of the Erstwhile Government of the State of Ajmer who retired before integration or opted for Central Rules and retired after 1.11.1956 from the State of Rajasthan, the Government of India sanctioned some reliefs, including grant of family pension.

            The reliefs granted by the State Government as mentioned in paragraph i were however, not extended to the pensioners who were employees of the former State of Ajmer, Bombay and Madhya Bharat and opted for pension rules applicable to them immediately before 1.11.1956, pensioners who are in receipt of pension sanctioned under the Ajmer abolition of Intermediaries and land Reforms (Pension to Intermediaries Employees) Rules Jagir Pensioners, Erstwhile States Pensioners (including those of Ajmer State), Rajasthan State Pensioners who retired prior to 1.4.1951 etc. The categories of service Pensioners to whom the relirfs granted from time to time by the State Government were not extended have been representing to consider their cases also for extension of such reliefs.

The matter has been considered and the Governor has been pleased to order that:

(i)         In partial modification of this Department order No.F.1 (29) FD (Gr.2)/87-II dated 20.10.87 regarding grant of minimum pension/family pension, the provisions contained in this order shall be extended to the Rajasthan State Pensioners/ who retired prior to 1.4.1951 and whose pension cases were decided in accordance with rules of the respective erstwhile states and the Erstwhile States Pensioners, including those of Ajer State w.e.f.1.11.1989 (In case of Pensioners of the Erstwhile State of Ajmer his order would be applicable only when benefit  of minimum pension/family pension as sanctioned by the Government of India has not been extended to them by the Central Government. The benefit of minimum pension/family pansion as per the order dated 20.10.1987 referred to above is already available to rest of the categories of pensioners mentioned in para 2 above in terms of the aforesaid order).

(ii)        In partial modification of this Department order No.1.F.1(29)FD (Gr.2)87-III dated 20.10.1987 regarding extension of revised formula for computation of pension, the provisions contained in this order shall be extended to the Erstwhile States, Pensioners, including those of Ajmer State, Rajasthan State pensioners who had opted for pension under Rules of the respective Erstwhile State or whose pension cases were decided  in accordance with rules of the respective erstwhile states, Pensioners who are in receipt of pension under Ajmer abolition of intermediaries and Land Reforms (Pension to Intermediaries Employees) Rules and Jagir Pensioners w.e.f. 1.11.1989. (in case of employees of the Erstwhile State of Ajmer who retired before integration and those who opted for Central Rules and retired after 1.11.1956 this order would be applicable only in case when similar benefit has already not been extended by the Central Government.

(iii)       The provisions of the order F.1 (50) FD (Gr.2)/82 dated 18.7.1988 regarding extension of the provisions of the New Family Pension Rules, 1964 to the widows of the Government employees who retired or died before 1.3.1964 or opted for Old Family Pension Rules shall be extended with effect from 1.11.1989 to the Jagir Pensioners, Erstwhile States Pensioners and the Rajasthan State Pensioners who retired prior to 1.4.1951 and whose pension cases were decided in terms of the rules of the respective Erstwhile States or their widows.

The procedure in regard to grant of minimum pension / family pension, re -computation of pension as per revised formula and grant of family pension shall bees contained in the respective orders referred to above and as laid down in the relevant rules.

This order shall not be applicable to the Old Age Pensioners Political pensioners and Pensioners in receipt of any other kind of similar pensions which are not related to the service rendered under the Government . The non-applicability clause as mentioned in paragraph 3 of the order No. F.1 (29) FD (Gr.2)/87-II dated 20.10.1987 regarding grant of minimum pension/family pension shall continue to be in force.
